Q 1: What is Annual Leave and who is Entitled for it?
Annual leave is a paid time off work granted by companies (employers) to workers (employees) to be used for whatever the employee wishes.
Please clear that a person who is working (full time work) under UAE LABOURS LAW is entitled to Annual Leave and it is a basic right of every worker written in various UAE Labor Law Articles.

Article 75 stated: “Employee is entitled for 30 days annually if his service exceeds one year. At the end of the service the employee is entitled to an annual leave for the fraction of the last year he spent in service”.

Q 2: Do we entitled for air ticket?
The most important aspect and the mostly asked question by our readers is that “ do we entitled for air ticket after completing 1 year of Service? The answer is NO. The company is not liable to pay air ticket to the employees. This is not covered in the UAE Labour Law.
In simple words Annual Air ticket or Air Fare procedure is related to company policy and practice and it is not covered under UAE Labour Law Articles.

Q 3: Who decides when to go on annual leave, Company or Employee?
If you are employee, you could decide when your annual leave starts. However, employer (Company) can change or divide your Annual Leave if the exigencies of work necessitate.

Article 76 stated: “The employer may at his discretion determine the date for commencement of annual leaves and, when necessary, he may decide to divide the leave in two parts at the most, except in cases of juveniles where vacation may not be divided in parts”.

Q 4: When we will be paid and what are we entitled for?
UAE Labour Law clearly states that every Employee should get his/her annual Leave once his/her service exceeds 1 year. After one year of service, employee is entitled for full Salary before taking his/her Annual Leave.
Please note many companies are in violation of UAE Labour Law by paying only Basic salary, you should be paid both your normal (Basic) salary and Annual Salary as well.

Article 80 stated: “Annual leave shall be paid to the employee before taking his annual leave, the employee shall be paid his full wage, plus the wage of his leave days he deserves according to the provision of this law”.

Q 5: What if there are public holidays during Annual leave?
In case of any official or Public holidays announced by Government during the Annual Leave, those days should be treated as part of Annual Leave.

Article 77 stated: “The calculation of duration of annual leave shall include holidays specified by law or by agreement, or by any other day because of sickness if they fall within the leave and shall be deemed to be part thereof”.

Q 6: What if Employee get sick During Annual Leave?
Article 82 stated: “If the employee falls sick for reasons other than labour injury he must report his illness within a period of two days at most and the employer must take necessary measures having him medically checked up to ascertain illness”.

Q 7: What if someone couldn’t come back to work within signed Holidays?
If an employee delayed the rejoining or couldn’t come back to work after Annual Vacation due to family or other issues, he/she will not be entitled for any pay for the days employees are absent.

Article 89 stated: “Subject to the provisions herein contained, every employee who does not report to duty immediately after expiry of his vacation, he shall be deprived of his pay for the period of absence commencing from the day following to the date on which the leave has expired”.

Q 8: Can employee be fired during his/her annual leave?
An employee working in any state of United Arab Emirates cannot be terminated by Company from his services while he is on annual leave.
If an employer (company) does dismiss a member of his staff while he/she is officially on leave, it may be considered an arbitrary dismissal and the affected employee can take course to legal action against company.

Q 9: Do I allowed to work for another company during my annual leave?
No, you are not allowed to work for another company during your Annual Leave or Vacations.
If you get caught while working for another company, your Company/Employer or Sponsor has the right to terminate your service without any notice.

Q 10: What if I worked for same company during Annual Leave Holiday?
As per Ministry of Labour Article 78, “if Employee made to work during his/her Annual Leave Holidays, he/she should get paid in cash on basis of his/her basic salary”.

Q 11: Can I entitled for Sick Leave during Probationary Period?
As per UAE LABOUR LAW Article 83 “During the probationary period, the employee is not entitled to any paid sick leave, If the employee spends over three months after completion of the probationary period, in the continuous service of employer, and falls sick during this period, he becomes entitled to a sick leave not more than 90 days either continuous or intermittent per each year or service, computed as follows:
A. The first 15 days with full pay.
B. The next 30 days, with half pay.
C. The subsequent period, without pay.

Article 78 Stated: “However if the exigencies of work necessitate that the employee works during his annual leave in whole or in part, and the period of leave during which he has worked, has not been carried forward to the next year, the employer ought to pay him his wage in addition to cash in lieu of leave for his working days based on his basic pay”.

Q 12: Do we eligible for Housing and other Allowances during Annual Leave?
Yes, Employees are entitled for Basic salary and Housing allowance during annual leave.

Article 78 stated: “An employee shall be paid his basic wage plus the housing allowance, if applicable, and any other allowances which he receives in the normal working month.

      Yes, you are entitled fro 7 Years Leave Salary Plus Increment.
      You have basic right to ask for Your Leave Salary, in case of Rejection, you can complain against Your Company at MOL, In case of Termination or Cancellation, you are entitled for Gratuity of 7 Years.

      Because we also used to have this issue until they explained to us..
      Let say your annual leave falls on 5 Jan-4 Feb (yearly)
      Did you receive your full salary by Jan 31 like the normal month?
      if yes, that is your annual leave payment. some companies i believe don't pay you outright; in this case, dec salary + leave salary by dec 31

  2. I am from outsourcing agent working as a bank employee. My agent said, during my annual leave which will start at the end og August, they will only provide my annual ticket & basic salary. They should br giving the same amount of my monthly salary. But they refused and mentiioned that they will only provide "Basic Salary" during my Annual leave. Is that legal?

    1. They are providing you ticket, it is not written in Law.
      and yes they are violating if they are not giving you a leave salary.
      You will have to get 2 salaries from them once you completed your 1 year with them.
      1 Salary for the month you worked (30 days)
      1 Salary for one year that you completed with them.

  3. Hi im also had my annual leave a few months ago. Im working in business company. I only received my monthly salary. Is it different to the Annual leave pay? Im workig for almost 2years already. Thanks

      Because we also used to have this issue until they explained to us..

    2. Yes it is, You will have to get both your normal work salary along with Annual Salary.
      Simple words, your company is liable to pay you 2 Salaries.
      1 For your 30 days work
      1 for completing ONE Year with them.

  4. Im more than 1year with the company. I asked only a 2weeks leave because for an emergency reason..but our company give me 2 options if i will take a leave..1st option he will cancelled my employment visa while on my leave/vacation once i go back he will make employment visa again for me..2nd option i will give my 1month salary as a security bond and my atm card and when im back to work he will returned my money and atm card..so is this possible?

My employer give me my annual leave aftet fulfilling my 18months of service but after my 24mos service he told me that i need to give him back the transportation allowance which he give ne when i applied for my annual leave. He told me that he should only pay basic salary and housing allowance during my annual leave. Therefore i should give him back the amount of transportation allowance as per labour law he said

  8. Good day! In the company im working, if an employer goes for annual leave, he/she receives only the basic salary and the housing allowance. The other allowance they will not give. For example: 5300 aed the monthly salary including all alowances. The employee gets only 2500 basic salary plus 600 housing allowance during annual leaves. Is there a violation on this matter?

    1. Yes there is a violation .. as per the labour law stated above. U r entitled for all the monthly salary as per the previous month. U should get all the compensation as well . In simple words.. u shld get 5300aed for the month u completed and plus 5300aed for ur anoul leave . In total u r entitled 10600Aed to be deposited in ur account or cash before u start ur leave.

Salam why the municipality not checking the company whos not following the rules,like public holiday in 1 year we have 10 but they are giving only 1 or 2 then increment most of my culeage 7 years 4 years but the salary still same overtime without pay is alway,hope that somebady can check this matter most of the hotel here is same, if we are sick we have to pay 15 for our check up why?

    My company are willing to pay me for my annual leave. What made me confused is instead of going back to my country to spend my 30 days leave, i decided and to stay in the country (UAE) and just file local leave. But my company is giving me 5 days (local leave) that will be deducted to my annual leave pay where as i will only recieve 24 days for my annual leave pay because i used 1 of the holiday recently.( in total of 6 days leave) How is it possible? Because as i understood, i have 30 days leave plus 1 month vacation leave pay and not to be deducted even you don't go back to your home country.

    Im under unlimited contract, been in the company for 1yr and 2months. Right now I am already rendering my 30 days notice period cause I already resigned. Within my stay in my company I have not consume my annual leave. Since im already resigned do I have the right to ask for my annual pay for the annual leave that I haven't use?

  30. Is this also applicable in freezone? I will avail my annual leave this coming September. My colleague told me that when they take their leave, our company gave to them only the basic salary. Do we the right to ask our employer to give to us the usual salary we get every month? Is this law only applicable under labor or even in freezone area?

Hi im working before in one of the companies there as a supervisor and sometimes we are working 16hrs a day and we are not getting any overtime pay for it or off-set hours..is it in the uae labour law that we are entitled for any overtime payment??and what i have this incident that i go for annual vacation and didnt able to come back since 1st we are not getting the right benefits for our overtime and 2nd my manager is harassing me..we have reported it to our top management but the top management just dismiss the case even we have a witness..and now i guess they already terminated me..am i still banned for it??or am i allowed to go back and look for new company??can i still use my more than a year experience as a background for my working experience???

      the Month you have worked for them, it may be July as per You.
      and second salary is Your Annual Leave Salary,

      Tickets fare are not written in Mol Articles, its up to company and you, many companies are providing annual leave with full pay and ticket expenses while few of them only giving annual salary without ticket.

    2. Hi good after noon. Im working at the mall food court section,we're selling an ice cream. I join the company last year 22nd of july 2015. But our emirates id was released on 4th of november 2015. So when will i start to count my contract, on july or november? And regarding for our working time, on week days our duty is 10hours including 1 hour break and on week ends is 12 hours. As i read my contract its say only 8hour plus 1 hour break. But our employer insist that it should be 10 hours. But on week ends we work for 12hours. Just want to know if what can we do for this,can we complain or compensate for our over time?

      Now you will take 2 salaries
      1: for the month of July (Normal Salary or your monthly salary)

And my boss is expat I'm 3 years here with a salary of 1,700 dirhams,she said only every 2 years I can get this free plane tickets and paid annual leaves,coz she said its in my contracts. But my friends told me that expat employer only one year visa basis not 2 years.So they must gives us every year one plane tickets and annual leaves.I'm 3 years working with them, I haven't go home for vacations.Last 2 years they gives me only 1,900 tickets and annual leaves,my salary is 1,700.And this December inshaallah,I'm planning to have my vacations but she said this vacations of mine the tickets is not free and no annual leave payment,coz not yet 2 years,is that right?.And if I'm going to go home for good,can i receives this 3 years graduity? And if I'm not going to renew another one year contract are they going to block me?     I was educated regarding Annual Leave by scrolling all the inquiries. However
    in my case, i completed my 1 year in the company last 10 July 2016 but i will consume my leave on 7th December 2016 to 4 January 2017 (1 month exact).

  63. Leave Salary for House allowance should be on total days entitled for leave or only on actual days of leave.
    e.g. leave entitled for 30 days if I plan go only 15 days, so I should be paid housing for 30 days or 15 days.

    Good day, I just want to share this with u, my company after the staff's vacation our office gets their leave salary once they report on duty (the staffs are required to return their leave allowance)..This is unjustifiable right? I'm already 4 years in my company, the first 2 years i finished it (i didn't renewed my contract) but i got my priviledges after it including the gratuity and the 2 yrs annual leave that was supposed to give before. Then, when I was in my country I decided to comeback to their company and they accepted me, they answered my employment visa and ticket. Now, I finished my 2 yrs again with them and I decided to get my vacation next yr that would be 3 yrs already, so shall I get my 3 yrs annual leave because I'm planning for 3 months vacation and how about my ticket? Does the MOL sets limit for airfare for each staff of the company? Do I have the right to get all those priviledges again and the 3 months vacation? And one thing they giving us once a month full day off and 4 halfdays a month.. Can we get those days that they didnt grant our off per week (is it included in the gratuity after the contract?).. Honestly, I know some rules here coz whenever situations that bothers me I ask to MOL representatives but like our situation in the company the staffs are afraid to cpmplain, afraid to lost their jobs..     1. As per Law you are allowed to live 3 months.
      As per Law you are entitled for 3 Leave Salaries.
      As per Law, if you have signed a contract with written Air Ticket in it, you will get it.
      as per our Experience and Practice, mostly companies are paying Return Air Ticket fare to employees who didn't travel or took holidays for more than 2 years.
      So, as you said you have not traveled for 3 years, you are entitled for all.

Just wanna ask about my case.I work as a nanny for 4 years when I go home for vacation after 1 year of service it happens that I go in the 15th of month say April 15.My employer give me only my one month salary because he said I only work 15 days and then when I come back on may 15 he will give me my full salary and that he said I still work only 15 days..Is that right way of giving annual paid leave?
      If in case after one year of service I will not go home I mean I will not go for vacation am I entitled the one month paid vacation and the two way ticket airfare? Please reply..Thanks

My joining date was Oct last year but I'm taking my annual leave next month which will be 21 days advanced prior to my completion of 1 year. My employer said that those 21 days will be loss of pay? When I was call sick and got absent for 10 days (official leave letter submitted later) the time attendance system automatically locked my salary and for next 4 months I did not paid any money. This leads worsen my financial situation and the bank's start lodged police case against me. Later I submitted my resignation however I failed to cancel visa due to bank cases.     After completion of 1 year if employee will be going for an annual leave of 30 days, then they wont get july month salary right? Only they will get paid their annual leave salary. Your answer is confusing many people.

If any employee is exiting for visa change and visq is not issued by ministry of interior due to some conflicts or on security reasons and during this period if employer sends termination letter on the basis of non issuing tje visafrominsrty of interior but later get clearence from immigration and employee comes back on visit later than 4 months.
    So what is the scenario. Can heask for his job or can claim for any compensation as employee is not defaulter by the mistake or some other reasons were behind his visa issue.

I was once took an absent the day before my off as I wasn't fit to work, I informed my supervisor and showed her my photo as proof of not being well... but when I got my salary they have deducted me a 2days salary for my 1 day absent...I wanted to know if it is legal to the company to deduct a 2days salary for the reason that the absence was happened before the regular off even if there's no memo or rules that have been implemented for the staff... thank you.

    this is about computing the working hours..
    im working as a home care nurse here in abu dhabi. we have 12 hrs duty per day 8am-8pm but we were picked up by 7:15am and arrived home almost 9pm. im just curious on how to compute this working hours because our company counted this as 10.5hrs only, not taking accounts the travel time and the continuous hours spent while in the patient's home. we never go out outside the residence for lunch or take the snacks. we did these inside the room of the patient. the company said that we're entitled 30min break every 5hrs rendered but i think it's not applicable to home care nurse because we still caring, facing the patient while having our meal..

    i want to know if it's possible that the company don't give free ticket once you completed your 2yrs contract? because as per contract we signed it is indicated there a free ticket after 2yrs.. but the company told. when you finished the contract and you don't renew with them.. you will not get any free ticket.. so it means we must renew our contract with them.. and as we signed and renew that the only time they will give us a free ticket. is that possible?

I'm eligible for 30 days this year but I'm only taking the half this time & the balance later this year. Our HR said it's not possible to get the salary + leave salary if my leave is less than 20 days and before the payroll date. Is this according to UAE Labour Law?

  123. Hi UAE Labour. Just a point of clarification cause I think most (if not all) UAE companies are not abiding with Article 80 or the Annual Leave Salary. And reading the comments, many are confused. So, let us itemized and put a situation.
    Example I will go Annual Leave on 29Sept to 28Oct 2016.
    1. Sept salary - i will get in Sept month-end, right?
    2. Oct salary - i will get upon return. October month-end, right?
    3. Annual Leave Salary - is this different from Sept and Oct salary?
    4. If yes in #3, is it safe to say that the Annual Leave Salary is like a "bonus" given to all employees who completed one year of service?

    I am working for a leading retail company in the region. We are asked to do split shifts 4 most of the days ,ie, 10am to 2pm , 6pm to 11pm by this time we finish 9 hours duty. Where as actually we are working for full day. We have to travel 4 times from and to.
    Kindly advice whether split/break shifts are allowed as per UAE labour law.

I am working in one of the top security company here in abu dhabi for 2years and I finished my contract and I didn't renew again, I am expecting to received more or less AED 10,000 for my graduty and annual leave salary for 2years and for the duty salary that they didn't given to me for the past month but they give only AED 2000 they say that i have fine because i didn't answer the call of my supervisor immediately and they say if I will complain to the labour they will put me in ban so I cannot apply to any company here in UAE. I just want to asked if it is possible to put me in ban like they were saying even they are the one who didn't give the money for my 2years? thanks for the response!

  136. Hi hello.. i am working as a nanny since when im start working them if theres a holiday like ramadan. Big eid . And islamic new year or any holidays that government give... my sponsor is local but my employer is different... im always working over time... and also my day off sometimes they didint give it to me. They take it but they never put in another day... and if im taking my friday off its only until 6 in the evening after that i will work.. i have been 3 yrs working to them evrytwo years contract... i am scared before to demand or complain its because my sir is many friends working in government.. im not saying that they so bad but i want them be fair only of what the rules have in my xontract they are not following on it... tnx hope u can help me... i want to resign to them but i am scared...

  140. 1. My leave salary is 8502.40 per month ... i have an unused leave of 29 days... how much should i get? And what will be the calculations... company calculation is (5314/30*15)+(8502/30*15)..is this correct?.
    2. i started working with them 1 oct 14 till 19 sept 2016. How much is my gratuity. Unlimited contract. Employer ask us to resign but never initiated to resign.
    3. And one more thing already 720 days with company and telling they will not give airfare allowance? Only 10 days left for 730 days. Need to complete 2 years or 730 days in order to avail. Is that correct? Should it be pro rata?

  141. Good day!My salary is divide as Basic Salary+Housing Allowance+Transportation Allowance + Other Expenses,but when we take our Annual leave salary they are cutting the Transport Allowance Please let me know if they are right to cut our transportation allowance.
    Basic : 1500
    Housing: 1000
    Transportation : 500
    Other Expenses : 500
    TOTAL SALARY :3500
    I get only Dhs 3000 they cut 500 for Transportation when the give my Annual Leave Salary.Is that correct

    I am working as a Babysitter here in UAE. My Employer just asked me to sign a document but did not let me read it. Now she's saying that my contract is 2 years, therefore I am thinking that the document I signed was the Contract. I am working from around 6am to around 11pm everyday. I already asked my Employer to give me a copy of my Contract but until now she's not giving me. Please, enlighten me regarding the below:
    1. Is there something else I can or should do so I can have a copy of my Contract?
    2. How many hours should I be working per day? 6am to 11pm is very long hours. Is there anything I can do about this?
    3. Am I entitled for a weekly day off?
    4. I am working here for more than 7 months now, if I wish to cancel my contract and go back to my country, is there anything I will pay to my Employer? I went here in UAE under a Tourist Visa and got a job here.

    My sister is on her 1st time vacation after 4 years of working in Company X. She is supposed to be back this 6th of February but she received an SMS from their HR giving her instruction that she needs to extend her vacation indefinitely due to manpower issue. Further, the HR/Company X will give her the advice when to fly back here in Dubai. She was also told that the ticket is already cancelled and should she comes back on her own expenses with out the Company X's permission, she will be facing problems.

    Sir, The vacation was preplanned and approved by the management,can Company X legally extend the leave with indefinite schedule while my sister is on her vacation? My sister has dependents that needs financial support, will she receive the vacation pay until she will be advised to return to work? If she will fly back on her own expenses, what problem will she be facing as being told to her?

    Need your expert advice.

  160. I had to take half days for opening a driving file. And another 2 half days for the driving theory lessons.
    My employer has deducted my salary for these half days.
    Is that allowed?

    If eid holiday is 12th, 13th, 14th, and i apply for vacation from 15th, will i not get my eid holiday pay?
    My employer has considered 12th, 13th, 14th, as part of my vacation and deducted my salary.
    same case for moharram and new year holiday.

  161. Hi i just want to clarify because im a bit confused. Here is the scenario.

    I will be 2 years of service in my company on June 10 2017 but didnt took my annual leave of my choice. After completing my 2years only i will take 1 month leave. So i have 1month unused leave. My question is will i receive any for my unused leave?

    Is the calculation like this?

    1st year completed:
    1) 1month full salary(leave pay) for the 1st year completed.
    2) 1month salary for my unused leave (basic+housing)

    2nd year completed:

    1. 1month full salary(leave pay) for every 1year completed
    2) plus actual days worked(ex. 20days)

    Is this correct?

  167. Please I need an open help in calculation. Please I have a work of 2000 basic but earn 2700 including food allowance applies to all those not taking company food whiles others earn 2400. Pls I want to know I have never gone for vacation in two years as in April will mark my full two years. I am asking on my vacation am I entitled to 2000 times two or 2700 times two plus my gratuity or how does it work and how much must I get as per UAE law? Another is if I am terminated within this left two months perioid or I choose not to renew my self how much also am I entitled to get pls help me in figures together with my gratuity. Thank you.

    Im on under servant visa my contract will expire on march 15 & they will not renew it..i just want to know what will i get from them. They say only half price of ticket & salary..
    I completed 4 yrs already..do i have the right to asked for the ff:
    1. 1month vacation leave pay
    2. 2 way price of plane ticket
    3. Gratuity
    4. 1 month paid salary (even expired by 15 only)
